Tomorrow the U.S. Ninth Circuit Court of Appeals will hear arguments on the long-delayed climate change lawsuit. The case was filed in 2015 in Oregon by 21 students who asserted a constitutional right to a “climate system capable of sustaining human life” and contend the government has violated that right and the public trust. They’ve asked a judge to order eight federal agencies to prepare a “national remedial plan” to phase out fossil fuel emissions, draw down excess atmospheric carbon dioxide and then monitor compliance.
